According to EU Directive # 2008/114, Member States must identify all industrial systems and subsystems having effect on economic and/or social safety. Infrastructures that implement, support, and operate such systems should be highlighted as the utmost importance for the stable and reliable operation of the country. Domestic regulation is based on the CLXVI. Statute and its implementation as of the 65/2013. (III.8.) Government Decree. The identification has been achieved in two steps: the first is the so-called "sector-level” identification (sectors are defined by the directive) and the second is the „horizontal” (cross-sectoral) identification.

During the first step, an identification report should be prepared for Officials in required content and format.

In the process of identifying the site as a critical infrastructure, the operator should determine potential critical infrastructures by preliminary risk analysis, according to sectoral and horizontal criteria.

The identification report forms the ground for the second phase - an official administrative „red tape” procedure - where the Authority carries out a designation process and, if necessary, obligate the licensee to prepare an Operator Safety Plan. OSP is a document that includes a detailed risk analysis of the licensee's critical infrastructural systems and facilities. This required risk analysis is fundamentally different from the major accident risk assessment, since in this case the protection of external civilian population is not the primary target, but the site of the licensee's premises should be protected from external influences.
